On Monday, May 20, 2019, the Administrative Court in Split rejected the lawsuit of Association for \u00a0Nature, Environment and Sustainable Development Sunce, the Association KEKS and the Municipality of Une\u0161i\u0107, which confirmed the decision of the Ministry of Environment and Energy.<\/p>\n\n\n\n
The\u00a0decision\u00a0of the Ministry was made after the assessment procedure on the need to assess the impact of the project – the\u00a0construction\u00a0of the\u00a0Le\u0107evica\u00a0Waste Management Center on the environment. In this procedure, the Ministry concluded that the project was acceptable, and\u00a0that\u00a0it was\u00a0not necessary to re-prepare\u00a0the environmental impact study.<\/p>\n\n\n\n
During the dispute, the legal team of Association Sunce insisted on the need to prepare an environmental impact study and a more serious assessment of the impact of this project on the environment. It also stated a number of reasons why it believes that the construction of the Center could have a potentially negative impact on the environment and human health.<\/p>\n\n\n\n
One of the\u00a0lawsuits, which\u00a0according\u00a0to the\u00a0plaintiff\u00a0is\u00a0disputed,\u00a0is\u00a0the\u00a0capacity\u00a0of the Center, which is not clearly determined,\u00a0i.e.\u00a0it\u00a0is\u00a0not\u00a0possible\u00a0to\u00a0determine\u00a0with\u00a0certainty\u00a0how\u00a0much municipal waste will come\u00a0to the\u00a0plant\u00a0and how\u00a0a certain type of\u00a0waste\u00a0will be disposed of. The\u00a0center\u00a0is\u00a0designed\u00a0as\u00a0part\u00a0of a unique\u00a0waste\u00a0management system in the\u00a0county, which means that the\u00a0amount\u00a0of\u00a0waste\u00a0brought into it and\u00a0disposed of\u00a0there, directly depends on the amount\u00a0of\u00a0waste\u00a0generated and properly separated and recycled at the\u00a0level\u00a0of\u00a0municipalities\u00a0and\u00a0cities\u00a0in our county. Given\u00a0the\u00a0poor\u00a0results of all local government units in the\u00a0county, there is a justified fear that the\u00a0capacity\u00a0of the Center will actually increase significantly, which will\u00a0have\u00a0a direct impact on the\u00a0environment\u00a0of the\u00a0wider\u00a0area in which\u00a0it\u00a0will be built.<\/p>\n\n\n\n
A written explanation of the court decision to all parties to the dispute will be delivered later, by mail. Association Sunce will appeal against the court’s ruling and decision to the High Administrative Court of the Republic of Croatia within the legal deadline and use the legal tools available at the European Union level.<\/p>\n","protected":false},"excerpt":{"rendered":"
